If you’re looking for a home to purchase, it’s helpful to know about dual representation and the potential risks that come with it. In most cases, the homes you look at during your search will be represented by real estate agents other than yours. However, it’s possible that you’ll come across a situation where the seller of a property you like is also represented by your agent. This may seem convenient at first glance, but this “dual representation” actually carries a lot of risk.

“The biggest problem with dual representation is it can create a conflict of interest, mainly because buyers and sellers typically have opposite goals,” says Heidi Hart, owner of California Dreaming Real Estate in Santa Cruz County. “The buyer is looking for the lowest possible price while the seller is looking for the highest possible price, so it’s difficult for the agent to please both parties.”

According to Heidi, the California real estate industry has implemented standards to prevent such conflicts of interest. “Per the standards of the California Association of Realtors, an agent has top fiduciary duty toward the client they were working with first in the transaction,” she explains. However, even with such standards in place, there’s no sure way to avoid the potential risks that come with dual representation, which is why Heidi generally advises against it. “It’s usually best to have your own representation as a buyer, especially if you aren’t familiar with the property. That way, you’ll have someone looking out for your best interests.”

Heidi says there are a few instances where dual representation can be beneficial. “If you’re already familiar with a property or know the selling party personally, dual representation can be quite convenient. In this type of low-risk scenario, not only can a dual agent streamline the transaction, but you can usually get them to reduce their commission since they don’t have to pay for listing or advertising.”

Q: Is it the right time to sell/buy?

A: The market is always fluctuating, but over the years, I’ve found that it’s less about what the market is doing and more about what’s happening in your life. If you need a new home and can afford it, now is the right time. I can advise you on things like market trends, but at the end of the day, your personal circumstances are the most important criteria to consider—unless you’re an investor or property flipper by trade, in which case different strategies would apply.

Q: Can you help me price my home?

A: Absolutely. I’ll perform a comparative market analysis to determine your property’s sale value and help you determine a winning asking price that exceeds your expectations.

Q: Do you have any advice for purchasing an investment property?

A: Every investor should know about the 1031 exchange. When buying and selling properties, a 1031 exchange allows you to transfer your capital gains from one asset to another to avoid paying property taxes. All you need to do is follow a few simple guidelines. I’m seasoned in guiding investors.

Q: Can you find me an investment property that already has a tenant?

A: Yes, but I have a better suggestion: buy an unoccupied property and let me find you a tenant after purchasing. In addition to being a Realtor, I’m a certified property manager, so I can find and pre-qualify a tenant for your property. The problem with assuming someone else’s tenant is you don’t really know what you’re getting into, which can be a big liability. If there’s already a current tenant, I can reapprove them or we can have them out before close as part of the contract.

Q: Is it worthwhile to get a home warranty?

A: I’ve heard feedback from both perspectives. Some people tell me it was just an additional expense they never ended up using, but I’ve also heard from people who had positive experiences. For example, if your furnace breaks, you can have it replaced under the home warranty. It all depends on the condition of the house. I’ll help you determine whether your new home would benefit from this.

Heidi Hart: A Perfect Opportunity

SANTA CRUZ — As a young mother of three, Heidi Hart knew that any career she pursued would need to have a flexible schedule. When she was offered a job in real estate, she knew it was the perfect opportunity. “I got my real estate license when I was 25,” she recounts. “It actually started when I was offered a job at a real estate office across from my kids’ school. Besides being in a convenient location, the hours were flexible, which allowed me to be available for my kids while also being actively involved in my community. I found that I really enjoyed the real estate business and I’ve been doing it ever since.”

Today, as president of Heidi Hart – California Dreaming Real Estate, Heidi says she enjoys multiple aspects of her job. “I’m a super-organized person, so I love micromanaging my files and keeping everything in order. I also enjoy negotiating, as well as meeting new clients and seeing different homes. The Santa Cruz Mountains area is very unique, with a wide variety of home styles, so that definitely keeps things interesting.”

Outside of work, Heidi engages in a variety of hobbies and pastimes. “I spend a lot of time working in my garden and taking care of our chickens,” she details. “I also enjoy cooking, sewing, going to the beach, and having friends and clients over for parties.” Additionally, Heidi likes traveling to new places. “My partner, Brian, and I take a couple of trips each year: one to somewhere in the U.S. we haven’t seen before and one to a tropical location. I also like taking my kids to Mexico during the summer—it’s relatively close and inexpensive, so it makes for a fun getaway.”

When asked the secret to her ongoing success as a Realtor, Heidi says it comes down to providing nothing less than the best. “I’m a strong believer in putting forth your best effort, which is what I do for every client I work with. Basically, I want my clients to be happy so they’ll refer me to their friends and family. Often, my clients end up becoming friends. I always enjoy getting a call from a past client who invites me to come out and see what they’ve done with the place.”

When asked the first thing she’d do if she were to retire tomorrow, Heidi says she probably wouldn’t. “At this point in my life, I’m able to do all the things I want to do, so I don’t see any reason to retire. Besides, I love my job. In all likelihood, I’ll be working long past the point where I could retire.”

A: Probably Spain or Greece. The only problem is I get really impatient with long flights, which is why most of my traveling is confined to relatively close locations. If they find a way to speed up air travel some more, I’ll probably go then.

A: Sew, make homemade jam or organize things.

    SANTA CRUZ — If you’re planning to sell your home, you’ll need to establish its value in order to determine the right asking price. In the real estate market, this is done using a statistical report called a Comparative Market Analysis (CMA). When performing your CMA, an appraiser will look at similar homes in your area that have sold within the past 90 days and calculate the average sale price to establish the approximate value of yours. The appraiser may adjust this number based on certain features of your property, such as a bigger lot or an additional bedroom.

    While a CMA is an important step in establishing your home’s value, keep in mind that it’s not the final word. Particularly in communities like the Santa Cruz Mountains, where houses tend to be very different from one another, it can be hard to establish an accurate number using only a CMA. After all, since a CMA merely calculates an average of what other homes have sold for, it doesn’t factor in many of the unique features that further influence a home’s value, like custom woodwork, plaster molding or high-end window treatments.

    For this reason, in addition to referring to your CMA, make sure you consult a seasoned real estate professional when determining your asking price. With their knowledge of the local market, an experienced agent or Realtor will be able to assess your home’s value with greater accuracy than a CMA.
